These Terms of Service ("Terms") govern your use of Nikkie ("the App"). By using the App, you agree to be bound by these Terms.

1. Description of Service

Nikkie is a service that uses AI to generate artwork based on diary entries written by users.

• Writing diary entries and generating AI art
• Viewing and managing generated artwork
• Free plan (with ads) and subscription plans

2. Accounts

An account is required to use the App. You are responsible for the following:

• Providing an accurate email address upon registration
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account

3. User Responsibilities

When using the App, you agree to the following:

• You will not enter diary content that violates any applicable laws
• You will not enter content that infringes on the rights of others
• You will not compromise the security of the App
• You will not use the App for any unlawful purpose
• You will not reverse-engineer, tamper with, or disrupt the service

4. Intellectual Property

(a) App Rights

All intellectual property rights in the App's design, source code, logos, and other elements belong to the operator.

(b) User Content

You retain ownership of the diary text you enter.

You are free to use AI-generated artwork for personal purposes. However, the legal status of copyright for AI-generated content is subject to applicable laws.

(c) License Grant

You grant the operator a non-exclusive license to use your diary text and generated artwork to the extent necessary to provide the service.

5. Fees and Billing

• Free plan: Includes advertisements and certain feature limitations.
• Subscription: Billed through the App Store or Google Play. Managed by RevenueCat.
• To cancel your subscription, please manage it through your device's store settings.

6. Disclaimers

The App is provided on an "as is" basis. Please note the following:

• We do not guarantee the quality, accuracy, or appropriateness of AI-generated artwork.
• We are not liable for service interruptions or data loss.
• We are not liable for damages caused by issues with third-party services (Supabase, Google Gemini API, AdMob, RevenueCat).

7. Limitation of Liability

To the maximum extent permitted by law, our liability for any direct, indirect, incidental, or special damages arising from your use of the App shall not exceed the total amount you have paid for the App in the preceding 12 months.

8. Changes to or Termination of the Service

The operator reserves the right to modify, add, or discontinue features of the App with prior notice. In the event of service termination, we will provide reasonable notice and endeavor to offer data export options.

9. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you within the App. By continuing to use the App after changes are made, you agree to the updated Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
